It is common for insurance policies taken out by entrepreneurs to protect their economic activity and include compensation for termination of activity. In the pandemic, many businesses have had to close temporarily, giving rise to the right to compensation from their insurer. Despite insurers having refused and continue to refuse compensation to their policyholders, our courts are finding that the insurers’ refusal is in breach of legislation protecting the insured’s rights.
